They've gotten into quite the habit lately of saying there's no common-law enforcement mechanism to constitutional provisions
I fear, Prof. Vance, for many in the judiciary the interpretation of laws and the Constitution has become a matter of backwards engineering. The desired outcome is known, and one's opinion more so interpret the law/Constitution to achieve that end. Per you and Asha, public trust is eroding.
