Alexis de Tocqueville's best-known work was his classic study "Democracy in America," analyzing our living standards and system of government during his travels here He noted America's cash bail system was aristocratic horseshit way back in *1835* 190 years ago:

Maybe it was the old peace bonds. Basically, you could go to a justice of the peace with a civil complaint (dude's threatening me & has a firearm), and the offending party would have to put down a bond to keep the peace. Maybe that's what he's thinking of; Saul Cornell described it once.

Fortunately he has zero authority to do this except in DC, where he probably also has near-zero authority, and he doesn't control the Federal courts either, but he needs to be in jail waiting for his New York State criminal case appeals to be finished.

The bondsman and actual money passing hands to bail out of jail is a relatively new concept in the US. Originally, bail was just a promise to pay (often made by another) if the defendant failed to appear.
