Alexis de Tocqueville's best-known work was his classic study "Democracy in America," analyzing our living standards and system of government during his travels here He noted America's cash bail system was aristocratic horseshit way back in *1835* 190 years ago:

Actual thing, back when imprisonment for debt was still common. See e.g. Beers v Haughton, 34 US (9 Pet.) 329 (1835) (This was back when half the SCOTUS ops were in Latin and Olde English so I can't claim to fully understand it) bsky.app/profile/conn...
No, making a joke bsky.app/profile/isaa...
It looks like the writ at issue there required a judgment—so not quite bail.
(Not good but not quite “you only litigate the merits if you first pay bail”)
Bringing back debtor's gaol will make America great again.
Are you confusing Olde English with Law French? en.wikipedia.org/wiki/Law_Fre...
Bail… in a civil case? Was this actually a thing or was he just wrong
Maybe it was the old peace bonds. Basically, you could go to a justice of the peace with a civil complaint (dude's threatening me & has a firearm), and the offending party would have to put down a bond to keep the peace. Maybe that's what he's thinking of; Saul Cornell described it once.
Would a $1 bail be in compliance?
How do we know Trump signed it
Isn't there something about reasonable bail not being denied somewhere. I could swear I've heard of that...
The expressed limits of my disgust are bound only by the fear that some PoS from this craptastic administration will deliberately misconstrue my words as threats and retaliate.
That’s why we have professional haters like Silky Johnson to articulate how we feel about Trump and his minions…
This has no effect on the states, though, right?
Fortunately he has zero authority to do this except in DC, where he probably also has near-zero authority, and he doesn't control the Federal courts either, but he needs to be in jail waiting for his New York State criminal case appeals to be finished.
I hope the top 500 or so people in the administration go to prison for at least 10 years each.
Can't wait till they make my existence illegal Police get me, no bail out- literally poor with no assets ICE gets me, we know the outcome Only a matter of time Solution to deal with this country is leave. Sorry -don't see congress turning blue in an attempt to halt his tyranny.
The bondsman and actual money passing hands to bail out of jail is a relatively new concept in the US. Originally, bail was just a promise to pay (often made by another) if the defendant failed to appear.
