Pretty much. California asked for a TRO while pursuing a full hearing. We had the temporary hearing with Judge Breyer who found in our favor. Then Trump appealed & they said Trump could keep troops while lawsuit continues. They also found against him that there was no judicial review at all.
Which is actually very important. The hearing today is with Breyer and on the original lawsuit. California could appeal to the entire circuit too so every judge weighs in. Not just three. I wouldn’t be surprised

I would’ve before this appellate decision. But the hearing today will start to show more. No matter what, I suspect it’s headed to SCOTUS
