It is perfectly legal to get a loan on your primary residence, buy a second house and turn your first one into a rental, and on the second home mortgage declare that it is your primary residence. Because it is.

stooooooop. she was already under contract to purchase the GA home when her MI refinance closed. There's every reason to believe that she continued living in MI.

Can still be legal. Had an offer on Georgia, refinanced Michigan to buy Georgia. Rightfully said Michigan is primary residence at the refinance. Intention was to make Georgia Primary residence when the deal closed. Legally said Georgia WILLl be my primary residence.

at absolute minimum it would give the lender on the MI property the right to immediately call the note
