That's an explanation for why he didn't charge Trump with insurrection. He was charged. He was set to stand trial. The SC bailed him out. But what difference would it have made? Voters elected him having seen it all with their own eyes, and knowing he was a convicted felon.

Ridiculous - January 6th just 14 days before the 20th when Biden took office- Trump is running from jail and tried to change the outcome if you remember. That's an insurrection.
