Interesting. The federal constitution has a ('relatively') clear provision, but that doesn't apply to state parliaments of course. I wonder what rules the various states have.

BTW, as I read Section 44 (of the federal constitution), you don't get to wait until 'all avenues of appeal are excluded'. It's sufficient to be convicted. That is the test there. www.austlii.edu.au/cgi-bin/view...
