No. AL only has death penalty for kidnapping if the kidnapper kills the victim. Kidnapping adults has a penalty of 2-20 years in prison, if victims are released. When cops imagine guns everywhere, they are even quicker to shoot first and ask questions later. This helps nobody.

Unless a state has legalized stopping without probable cause it’s an illegal detainment. The key is to have video evidence to show that there was no probable cause. Then you have to be willing to be arrested and booked and pay for attorney
