Thinking a President can serve a third term through some ingenious scheme because the 12th and 22nd Amendments prevent only a third "election" is like thinking a VP can preside over his own impeachment trial, the constitutional equivalent of a scrivener's error. Constitutional law isn't a word game.

It's right ie the 12th amendment anyway. Constitutional eligibility applies to VP as well. VP gets elected - separately. So whatever is in the 22A counts. However, if a former President works as someone within the lower chain of succession, then the distinction applies.

What about the originalist/textualist majority of the Supreme Court? Given the legislative history of the amendment (initially passed by the House with language not limited to elections), I’m skeptical the Robert’s Court will find a compelling reason to ignore the plain language of the amendment.

To be a bit fair to the Supreme Court here, their argument was that just because a lower court judge had found that Trump supported an insurrection, it wasn't concrete enough to qualify under the amendment (which is stupid, tbf). It's hard to argue that Trump didn't serve two terms.

It is impossible to eliminate ambiguity. Words are ambiguous, always. It's impossible to pile on enough words to anticipate all the ways someone might read it. (Believe me, lawyers try. Read a long-form warranty deed.) Trump's lawyers work to create ambiguity where no one else has ever seen any.

One way that been floated is being named Speaker of the House (legal, although super greasy), then elect/install a puppet President and Vice President, and have them step down. It may trigger an election cycle, but instituting martial law can get around that. It's not as far-fetched as people think.

pretty clear language in section 3 of the 14th amendment made T ineligible to appear on ballots, and the court set that aside. i fail to see how this is substantially different. if the court can ignore one part of the constitution, why not others?

It maybe isn't supposed to be, but I've seen some Supreme Court decisions, with their explanations either for or in dissent, that seem to be just that. And, I'm definitely not a lawyer - but the combo of 22 and 12 seems clearly not legal, and certainly against intent.

Trump runs for a third term. Congress passes a law removing Trump from the ballot. Trump vetoes it. Since 34 senators still support Trump, the vote to override the veto fails. Trump stays on the ballot. Trump wins the 2028 election. Since 34 senators support Trump, impeachment is off the table.
