Yes, but if they directly and clearly lied to him upon direct questioning, every judge would be justified in not trusting any assertion ever made by counsel for DHS ever; I don’t think even DHS would be stupid enough to do it with that clear a trail.
Well, I think that's what did happen in the JGG case, if I recall correctly. I do think DOJ would do it until the Supreme Court denies a DOJ emergency application to vacate it. Truth be told, I think that even if the Supreme Court denies the application in one case, they may grant in the next one.
