Sure it does. Women know what they are in for when they report a rape. That's why the vast majority of rapes go unreported. Unreported rapes FAR out number false accusations.
Bottom line is that these kinds of rapes, almost rapes, close to rapes and actual rapes are difficult to prove according to legal standards. Just the way it is.

Even when rape is proven it's not punished. Brock Allen Turner > 6 months in jail when he was caught raping a women behind a dumpster and pulled off her by 2 passerbys. Why? Because the judge said he had a lot of potential and a longer sentence would "have a severe impact on him".
