It is my understanding that the DOJ doesn't have the authority to make that appointment. It needs to be challenged.
Everything is being challenged - the wheels of our government are way too slow to deal with this planned onslaught by the Trump administration. It is an obvious weakness of our system. By the time the courts decide, these questions will be moot because Trump will have seized absolute power.
The system is *meant* to move slow, exactly to prevent a radical takeover like this. But with the SCOTUS seemingly entirely committed to crafting a monarch, overriding all the failsafes, the process is broken, and fascism is barrelling through unimpeded.

Because the Senate did not approve Habba's appointment within the 120 day period required, the NJ federal judges were acting lawfully to appoint an interim US Attorney. By reappointing her for more than 120 days, Trump is exceeding his Article II powers. But Trump exceeding his powers is old hat.
