I thought some people's DNA makes them born psychopaths, lacking the capacity for empathy from the get go.

Not all psychopaths are criminals. And not all psychopaths are born that way. Having a genetic predisposition to psychopathy/ASPD isn’t a sufficient condition to becoming a full blown sociopath. There’s an environmental element that triggers the mind of those afflicted.
