Better late than never. Lyft and Uber won a huge victory when Prop 22 passed in 2020, meaning they could exploit drivers instead of a previous ruling making drivers all employees. Also why wasn't this door open in the first place??! #rideshare #labor

These people are not employees of this company so this agreement is entirely a new thing. It goes against laws and of course what the companies want so they all had to negotiate to make it work. Contract employees don't legally have the right to form a union. Gig workers don't fit in that model.

Disruptive industries. We used to have well insured, bonded companies that hired profession drivers with special licenses who were also bonded and had unions. They were called Taxi's.
In my city, the Taxi industry was so dysfunctional that it was almost impossible to get a cab on a Friday or Saturday night. It was a risk to go out if you were a woman. Uber changed that. It’s one industry that did it to itself in my mind.
That was on your city elected leaders. Taxi companies were highly regulated and answerable to the local politicians or they could lose the PUC license.

That makes sense. What people tend to forget is that collective agreements also protect the employers. There are clear parameters marking duties and responsibilities in accordance with local employment laws and standards, for all parties involved. Unions are not bad.

Why did they need to make a deal.? If Uber drivers are not employees, then they are engaging in the largest coordinated price-fixing scheme in the history of the country. Uber should have been given two choices, unionization, or getting shut down due to antitrust.

The fact that management have a say in people forming a union is already a failure of labor organization.
As a unionized truck driver I've always been concerned about the safety aspect of these gig jobs. We have to adhere to a strict quota of driving and down time, and do daily safety checks on any vehicle we're assigned to. I really can't imagine that Uber or Lyft does anything similar.
Besides contractual boilerplate that absolves them of any responsibility in these areas.
Gig worker may win at the expense of the public. This insurance win is massive for Uber & Lyft. "Cabaldon’s plan.. slash the min insurance req. to $60k per person and $300k per incident." Public will lose, workers still have to fight.

Entry into Uber driver Dom is pretty easy. How will the union drivers have any power for better pay conditions? Strikes don't seem likely to work. Feels like another seiu Grift where the union benefits and the drivers get fucked over
These are contract workers not employees so they don't even have a legal right to form a union. These are gig workers who mostly drive part time to subsidize their income, one weekend of drivers skipping driving on Friday and Saturday night is a strike and a good one.
But there is a huge oversupply of Uber drivers active, inactive and potential. How would they be enticed to join the union much less strike? No matter what California does, they can't trump Sherman. A strike could trigger a cartel, restraint of trade federal action. It is going to be interesting
A oversupply will eventually fix itself - in basic econ. I didn't know there was an oversupply but that makes a union even more difficult to exist in this environment. I'm not sure you can convince a gig worker to pay union dues. I didn't say they would strike, just that they can without a union.
I don't know how big the oversupply is. My understanding is tha a lot of people sign up for Uber, decide they don't like it and stop driving. If they heard of a strike, they might see it as an opportunity to earn a few bucks at surge pricing. Speculation on my part
Any individual can withhold their labor at any time for any or no reason (absent a contract etc) But if you and I agree to withhold our labor, even if not asking for anything it is a "conspiracy in restraint of trade" under Sherman antitrust act. NLRA carved out an exception for many employees

I've been a gig worker since 1985 (independent sales rep & laziness trainer) I've had to jump through hoops to maintain non-employee status. Seems like this creates a sort of "not employee" / "not independent" status. How will the irs treat them for taxes?
I get why. I've done gig work that paid very well but when I need health insurance, I need a regular job. The marketplace helps though. They don't need permission to form a union but they wouldn't have any legal protections w/o this. I'm not sure why the IRS would change what's being done now.
There is a 5-10 page irs regulation that defines who is an "employee" and who is an "independent contractor" this is pretty strictly enforced. Which they think you are can have a huge effect on your income taxes, what you can claim and how you pay them.

Anyone can strike, anyone can form a union (this has a legal def) but as contract workers this is not the same thing and they do not have many of the NLRA protections like if you go on strike, you have no protection and the employer can legally fire everyone on strike. They're not the same.
