That would be up to an immigration judge, but probably influenced by the prior orders granting him release. Those orders might even be considered collateral estoppel against the government (but probably not).
Yeah, okay. I just have no faith in immigration judges. I guess KAG's lawyers can ask for a modification of her order if it becomes relevant, maybe?
