Not sure, but I know that one of them that is suing for being on fairly fired said they were unable to access their personnel files and locked out of their email so they had no way of providing the evidence that they were receiving merit, promotions, etc., and had no complaints against their work.
So creepy to lock HR files. I'm no attorney, but losing those files sounds like it can cause immediate harm. If the person searches for work or files unemployment, they need the files. I'd be asking the lawyer about emergency orders. It might be possible.

You can apply for unemployment in that circumstance. States handle it in various ways. In my case, it was denied and I could appeal. They asked for my explanation and evidence and those of the employer.
If the fired employee is locked out of systems and unable to access the evidence it adds insult to injury. Illegal… but happening to our great, dedicated civil service workforce. 😡

It’s not legal because it is absolutely not based on performance and they are not giving the notice is their contracts. In addition, they are making way for employees that meet the loyalty tests. Many country’s beaurocracy and professoriate turns over with President on loyalty-what a waste!!
