If it needs 61% then it does require 4 of 5 votes. 3 of 5 votes only gives 60%. I think he's a horrible human being but he's technically correct here.

I'd politely disagree. In order to get over 61% he needs 4 out of 5 votes. There is no need for an "or", He's still a cnut.
