WAPO had a good article today on the 'chicken tax'. It was a tariff on pickup trucks imported from Europe in retaliation for a tariff Europe put on chicken they imported from the US in the 1960s. These tariffs are still in place today. The point is that its very hard to get rid of these things.

The Supreme Court had the opportunity to uphold a lower court injunction which would have prevented the roll out of global tariffs. They chose to reverse the injunction and let the tariffs go forward. Now they will say that it would be disruptive to nterfere with the Executive Branch discretion.

This Supreme Court has been mostly compliant to Trump. I don’t think they will consider sunk costs but they will put a heavy burden on any ruling that goes against him. Although obviously wrong, I think the Supreme Court will rule to keep tariffs as long as Congress doesn’t exercise their power.
