Those agreements weren't in writing, so that's not actually a problem. The cash paid in import taxes is simply returned, like a tax refund. They know which importer paid it. So just give it back. No money is lost.

That purported problem is an "own goal" by Trump. Instead of pausing his ill advised tariff policies and actions when the first court decision came down, Trump took the stay of the decision as not just permission but recommendation to continue. He should have stopped then and completed litigation.
