Those agreements weren't in writing, so that's not actually a problem. The cash paid in import taxes is simply returned, like a tax refund. They know which importer paid it. So just give it back. No money is lost.

This ruling is headed to the SCOTUS where it will be a real test of how much latitude they will give to the POTUS. Can the POTUS bypass Congress and claim an emergency that warrants tariffs when there is no real "emergency". What is an emergency? Is this an "official act" of the POTUS?
It's an official act just like the bribes he demands. SCOTUS will rule that "emergency" means exactly what the President says it means, no more, no less, on their theory of executive power and the horrific idea that presidents would have to wait for judges to decide what an emergency is.

Any difficulty that flows from a further court upholding a ruling of illegality of his actions is entirely on him. He needs to be working on a solution now, rather than rely on the argument to the high court that "It's hard to do this right, don't make me follow the law!" & "I don't want to!"
