Today is probably a good day to point out Article 4 Section 5 of the Indiana Constitution, which allows for apportionment of senators of representatives only after the decennial (every 10 year) census

I presume the counter-argument would be that the language requires apportionment every 10 years but does not prohibit doing so more frequently. (Don't get me wrong - I think annual re-gerrymandering or whatever they have in mind is bullshit.)

I think Art. 4 sec. 5 applies to state legislative districts only. Art 4 is about the General Assembly. There is an Indiana statute, IC 3-3-2-1, providing the same re congressonal districts, but I suppose they could repeal it in the special session before redistricting.
