I believe the time stamp data that they have in court record that shows Luigi was capable of biking an average of 38 mph through NEW YORK in order to have committed this crime. Either they got the wrong guy, or Luigi should have been an Olympic cyclist.

You could have a motorcycle in New York and not make it that distance with total disregard for the law at 30 mph.
