Not a defense attorney who follows you, but unfortunately it's entirely legal for cops to test DNA they take from leftover food items

Entrapment only applies when the conduct being solicited is illegal conduct that the person is then arrested/charged for. Unfortunately it's not entrapment if the police get you to do something that they use against you. So giving someone food so you can then take it and test it isn't entrapment
