If you are not free to leave, you are under arrest. I don't care what else they want to call it. They are violating Posse Comitatus and that is it.

How about let's not pretend that Joe Schmuck has any more legal expertise on the subject than the 19-year-old soldier, huh? If you're not in cuffs, yes, ask if you're free to leave. If you are, leave. If you're not, just shut the fuck up until you can call an *actual* lawyer.
