5th Cir., 2-1, holds that Texas' ban on compensating people who assist voters with mail-in ballots is not preempted by the Voting Rights Act. Held: federal law does not really mean what it says. www.ca5.uscourts.gov/opinions/pub...

At bottom, nothing compels us to read “a person of the voter’s choice” in a maximalist way that erases swaths of state election laws.Context and common sense counsel a more restrained reading—one guaranteeing eligible voters help from “a person”18 of their choice, while allowing states to superintend voter assistance. Recall, moreover, that we are reading the phrase, not in the abstract, but in the context of a preemption claim that faces steep odds. As a “purposes and objectives” claim, it must surmount a “high threshold.” Barrosse, 70 F.4th at 320. As a claim involving core state authority, it must demonstrate Congress’s “clear and manifest” intent to preempt. See Deanda, 96 F.4th at 761. Section 208 comes nowhere close to meeting those standards. So, the district court erred by relying on the text of Section 208 to find preemption of the Compensation Provisions.

By a 7-4 vote, the full Federal Circuit has *affirmed* a lower-court ruling holding that many of President Trump’s tariffs exceed his statutory authority. The ruling won’t go into effect until October 14, though—which gives the Trump administration plenty of time to seek intervention from #SCOTUS:

My article in this month's edition of the Texas State Bar's Appellate Advocate is about a fun* idea I had - the Scrimmage Moot. I believe the full article is currently only available for members, but I'll link it when I can. *Fun if you're an appellate lawyer.

Professional football teams often engage in scrimmages or joint training sessions against their opponents as a form of practice. These informal simulated games expose weaknesses, refine strategies, and give players invaluable live experience. Trial lawyers have long borrowed from this model, using mock trials and focus groups to sharpen their skills and test their cases against something closer to live fire. Yet, in the appellate advocacy arena, where precision and persuasion are paramount, there seems to be no comparable exercise. To be sure, appellate lawyers often participate in moots where they practice their arguments against questions from “judges,” but the missing ingredient is an opponent. See, e.g., Jeffrey T. Renz, Prepare A New Lawyer for Oral Argument: The Seven-Moot System, Fed. Law. 42, 45 (2019). The first time we hear our opposing counsel’s oral argument strategy is when the real judges are sitting on the bench. This distinction suggests the potential of a “scrimmage moot” for appellate lawyers—a novel approach that could improve how we prepare for appellate oral arguments. Imagine a scenario where appellate advocates from both sides of a case come together to argue before a panel of neutral, expert, mooters. This setup would provide a true test of the strengths and weaknesses of each side’s arguments, fostering better preparation, clearer arguments, and perhaps even facilitating settlements. True Story: I was involved in a Netflix docuseries. When we won the big appellate case overturning 1000s of wrongful convictions, we were, of course, not in court. So we were asked to capture the moment by... reading parts of the decision aloud from a computer. It went as well as you'd guess.

Immediately starts harassing a new student. And incredibly, even though everyone knew what he was like, the school district claims they acted lawfully when they rehired him!

In fall 2017, Plaintiff-Appellee Matthew Loera enrolled in Villarreal’s theatre class at H.M. King. Villarreal asked students for their phone numbers to “coordinate . . . small group meetings” for his class and, a few days later, began texting Loera. The texts were “casual” at first, but within a few weeks, they escalated. Villarreal told Loera that he “wanted to know what all the hype was about” and repeatedly asked for photographs of his genitals. Loera sent Villarreal a photograph, thinking that “[m]aybe it would have made him leave [Loera] alone,” but Villarreal’s texts became even more insistent and explicit. Loera sent Villarreal five or six additional photographs. In addition to requesting photographs, Villarreal bought Loera food, shoes, watches, sunglasses, and a gold chain. He also kissed Loera on one occasion and, after delivering food to his home one evening, “[ran] his hand down [Loera’s] chest towards [his] private parts.”

In cases like this one, the Government should just take their checkbook out and ask how much should be paid, not mess around with ludicrous immunity arguments. A teacher openly "dated" a student and left the school. Then he's rehired and 1/ www.ca5.uscourts.gov/opinions/pub...

Villarreal and Cuellar’s relationship was not a well-kept secret in the community: they went to dinner with H.M. King’s then-Assistant Principal Velma Salinas, and Cuellar accompanied Villarreal on vacations with his parents. The government will receive a five-year warrant, at $20 per share for an additional five percent of Intel common shares, exercisable only if Intel ceases to own at least 51% of the foundry business.

One of my partners just told me that in law school he didn't know what a justified margin was. He would get assignments back with the comment "justify" on the side of the page and think, "I've already written a justification, what more do they want me to say!"

The statutory text is here. It's sort of pretty broad, but also so broad you can see why someone would say it wouldn't cover a life boat.

“Equipment” includes “machinery, equipment, or implements or attachments” that are “used for, or in connection with,” a laundry list of overlapping categories: “lawn garden, golf course, landscaping, or grounds maintenance;” “planting, cultivating, irrigating, harvesting, or producing agricultural or forestry products;” “raising, feeding, or tending to livestock, harvesting products from livestock, or any other activity in connection with those activities;” or “industrial, construction, maintenance, mining, or utility activities or applications.” Id. § 57.002(7)(A)(i)–(iv).
