The scandalous part of the recent Dem revelations is how bad and ineffective those efforts were rather than the existence of them.

Data-washing is already a pretty serious problem - it couldn’t have been discriminatory because our objective model made the decisions don’t you see! - and going whole hog on speech protections would make the issue exponentially worse.
For one thing, how would you go about proving the necessary knowledge and intent for various torts or penalties that could apply to certain speech when the words in question are produced by something that has neither knowledge of anything or the ability to have any sort of intention?
And, like LLMs SHOULD be regulated. I can’t imagineer a perfect legal regime to apply to them off the top of my head, but I think calling them “speech” is way too permissive and approach.
Saying they aren’t “speech” isn’t the same as saying they don’t require some degree of protection, so to the extent that’s his counter to my disagreement, it’s a false dichotomy. I think the scenario you suggest isn’t hard to comp to a viewpoint restriction.
I think I mentioned in 1 iteration of this convo that I can certainly see good arguments for punishing or restricting LLM/coding-generates outputs requiring a higher standard than rational basis, but I think we’ve lost the plot from both a technical & philosophical standpoint if we equate to speech
Unlike a book, the output of an LLM model contains some of the form but only accidentally any of the substance of human communication.
I think not putting a bright line between expression intentionally produced by a human being and the “expressive actions” of some (to this point not-remotely-sentient) automated process will lead to some very dark places.
Which part, the basketball, the law degree, or the data science? I just wholly reject the notion that the output of a model which produces text due to statistical processes belongs on the same continuum as human language. Of course I think it’s ridiculous that corporate comms should count, so…
Essentially it’s a whole bunch of people who have forgotten (or “forgotten”) that the map is not the territory. As OP alludes to, these people are completely ignore the degree to which the data of language abstracts away from vital features of *communication* or *thought*.
In terms of the “conduct” at issue a person or people put words together in a certain order in one situation and didn’t in the other. A book is to spoken speech relative to LLM output in the same way as Brian Scalabrine is to LeBron relative to a good high school player.
That’s a very silly comparison.
This doesn’t much affect their ability to sue if they didn’t opt in to the class. (Disclosure I am a member of the plaintiff class in one of these suits)
Is my code expressive speech? There are words in it. I can see reasons why THE ACT of coding might be considered expressive but I have a hard time seeing how the code itself should be, though I can also see reasons why rational basis would be insufficient to evaluate restrictions.
I mean that kind of trade (young player on good contract for slightly better older player on a mediocre to terrible contract) would get massacred if it happened in the NBA.

Words have meanings and you don’t just get to make up what those meanings are. For example “proposing a law that would need to go through normal processes to go into effect” is not in any way “a shakedown”. I’ll let you draw the appropriate distinction here.
