Indeed, although last one was best season for a while. Those are good reasons but my question was purely about the expectations of people about this situation of the charges. I believe they are based in a good place but are translating into a witch hunt. The charges are awful but keep a evel head

For all those demanding AFC come clean CPS βWe know there will be significant public interest in this announcement, but it is absolutely vital that there is no reporting, commentary or sharing of information online which could in any way prejudice these proceedings.β
Tony Udall (@wivus.bsky.social) reply parent
Could be but CPS say.. βWe know there will be significant public interest in this announcement, but it is absolutely vital that there is no reporting, commentary or sharing of information online which could in any way prejudice these proceedings.β AFC will say nothing. I should be a lawyer π
Tony Udall (@wivus.bsky.social) reply parent
No it is not, we agree on that. Enjoy your weekend
Tony Udall (@wivus.bsky.social) reply parent
Now they are doingthings the legal way. May not be popular with some but they will not be drawn into a legal battle
Tony Udall (@wivus.bsky.social) reply parent
I am not sure how many ways to put this. They will not say anything. Instructions from legal will be that. Live case, say nothing until iover. If they say the contract did not have a morality clause then the press will conclude AFC did not sack him because of that and would have if they could.
Tony Udall (@wivus.bsky.social) reply parent
It does, of course it does. If the prosecutor calls the CEO, Manager etc to court to ask about what they heard, why they investigated etc it would be a huge impact and certainly prejudice the case. AFC lawyers would have been handling the whole thing from the day it came to light
Tony Udall (@wivus.bsky.social) reply parent
We are going back to morals again. You believe your morals are right and others not. This is an opinion, not reality. Reality is 100 different things (and I am not going into a sixth form philosophy discussion on subjectivity now π)
Tony Udall (@wivus.bsky.social) reply parent
We are going around in circles. As my original answer said..why? They certainly will not be able to comment without prejudicing the case and they will not disclose details of contracts anyway. No player would want that. All this questioning does is reflect people's anger rather than improve.
Tony Udall (@wivus.bsky.social) reply parent
Well, because it is a live case and they will blank it all. They cannot comment. It's a live case.
Tony Udall (@wivus.bsky.social) reply parent
That would be an oiled tightrope over a minefield. Imagine if the press got hold of that and certainly the prosecution would use it, if only to drag the club into the middle of mega court case. Legal would have put a stop to any ideas of that I presume.
Tony Udall (@wivus.bsky.social) reply parent
They could do nothing about his contract. Legally he is innocent until not so, unless there is a very strange clause in it, his contract will come under Common law. No sacking without just cause and accusations would not fall into that. Again I think Mendy would have underlined that for them
Tony Udall (@wivus.bsky.social) reply parent
They won't. Don't have to and, legally a minefiled when the court case arrives. They will blank it all because it is a live case.
Tony Udall (@wivus.bsky.social) reply parent
Well again they could not approach either for that unless a final ruling had been made, otherwise the contract would not have been breached.
Tony Udall (@wivus.bsky.social) reply parent
The club could not approach either court until the Police had concluded their investigations. Not the women. Also, thinking about it, I would presume they would have been advised not speak to anyone due to prejudicing any case. Prosecution would have a field day
Tony Udall (@wivus.bsky.social) reply parent
Hearing from the club? Tt will be asked many times by the press. Answer will be no laws broken, internal investigation/review taking place. Which it will as they certainly do not want anything like this again. It will liaise with the PL to get a cover-all for all clubs. Sign Sesko it's chip paper π
Tony Udall (@wivus.bsky.social) reply parent
It appears it heard from at least one woman. So did the Police. It has taken them nearly 3yrs to collate everyhing to lay charges. The club is certainly not in a position to legally act on that. It would, without doubt, have taken legal advice as to what it could and could not do.
Tony Udall (@wivus.bsky.social) reply parent
There is but still needs proof of a level. Neither could be approached until the Police concluded their initial investigations, so the club could do nothing. If the case is a serious case in a Crown court it may not be permissable to go through Civil court depending and the out come is compensation.
Tony Udall (@wivus.bsky.social) reply parent
That's fair enough. It's not that I do not believe them, I do not not believe them. I believe it's not my place or anyone else's other than those given as much evidence and background as possible. How do we increase conviction rates for these crimes? A lot of changes for certain but blind belief?
Tony Udall (@wivus.bsky.social) reply parent
Agreed
Tony Udall (@wivus.bsky.social) reply parent
Of course it is but if you do not use that measurement of guilt then what? Public opinion? Jeeze, Trump, Johnson, Brexit etc. Damned if I am going by that. The criminal justice system is hardly fit for purpose but it is the only system we have. Otherwise chaos. Otherwise Twitter wins
Tony Udall (@wivus.bsky.social) reply parent
You didn't watch his last season then? If you are going to go down that route I should point out I am a ST and watched virtually every game, home and away for both. After Auba renewed his contract he was appalling.
Tony Udall (@wivus.bsky.social) reply parent
Indeed and that's awful.
Tony Udall (@wivus.bsky.social) reply parent
It would have to be a policy within the current employment laws. Look at City and their actions with Mendy. Basically the law of the land will always supercede any PL ruling or guidelines. Suspending or ending contracts is a tricky thing and a slippery slope.
Tony Udall (@wivus.bsky.social) reply parent
Yeah, I did, you're right. My bad. Still think it is all about this but I retract that and apologise. I am not being obstinate, I have a different view to you. I am making an argument for it. Doesn't make me right as it is my view. Same as you, your argument, as yet, has nothing to prove it right
Tony Udall (@wivus.bsky.social) reply parent
So if I accuse you of rape your company should sack you?
Tony Udall (@wivus.bsky.social) reply parent
They were not frozen out, they didn't play because they were not good enough and an agreement was reached to end their contracts early. You don't remember how awful they were?
Tony Udall (@wivus.bsky.social) reply parent
You keep repeating that. I truly have no idea what to say. I have agreed. Are you saying people are guilty by Twitter?
Tony Udall (@wivus.bsky.social) reply parent
I didn't presume anything, probably why I asked "why". Anyway the club, like any other business, is not obligated to go through the process with anyone, but I am sure the Press will push anyway and the Club will give the response it wants. For certain an internal review will take place.
Tony Udall (@wivus.bsky.social) reply parent
Your right thing
Tony Udall (@wivus.bsky.social) reply parent
Agreed, but they still have to be proven guilty, absolutely in a legal court or by probability in a Civil court. None of this has happened. What has happened is you presuming guilt without due process. He may be guilty, but that's to be decided. Your opinion, like mine and the OP is irrelevant
Tony Udall (@wivus.bsky.social) reply parent
Your right thing. That's irrelevant
Tony Udall (@wivus.bsky.social) reply parent
What is happening here, and across SM generally is a moral position of guilty until proven innocent, which the club cannot act on. So, my reaction to the OP is not to do with Partey and his guilt. If guilty I hope he is sentenced accordingly. My view is that the OP presumes guilt and club complicity
Tony Udall (@wivus.bsky.social) reply parent
Suspension is only allowed if they have carried out a full risk assessment. Now this also includes potential harm to the company. The assessment must show a strong risk for suspension to take place. There is a more tenuous opportunity relating to charges and police investigation but difficult
Tony Udall (@wivus.bsky.social) reply parent
Ok where to start. Yes we do know what they could have done, it's employment law. The Athletic printed the options when this first came to light. Sacking is not allowed until the point is reached where guilt is established. Morally they would be presuming guilt as it is not proven.
Tony Udall (@wivus.bsky.social) reply parent
No, but what is your reason for them not doing so?
Tony Udall (@wivus.bsky.social) reply parent
Laws are morals formalised. Societies values made legal. It's why they vary. So, as they could not have done much legally what action should they have taken?
Tony Udall (@wivus.bsky.social) reply parent
Which is why I said they are also being sued. Suspension is only allowed if a risk assessment is completed and it shows reason to suspend. It is not just about the money. As he was found not guilty then City must have had a hell of a good reason to suspend or be in breach.
Tony Udall (@wivus.bsky.social) reply parent
It's a criminal charge he has received. Civil court may follow. You believing is irrelevant. He may be guilty, but not yet. Morally you are taking a contrary position to the law of the land. There have been one or two cases where the charges have not led to a guilty finding. The CPS is not faultless
Tony Udall (@wivus.bsky.social) reply parent
City were found guilty for stopping paying. Common law works on innocent until guilty. They had to pay him back pay but I believe, will check, he is suing them. He was found not guilty anyway but even if he was found guilty employers are not allowed to stop paying people unless it's self inflicted
Tony Udall (@wivus.bsky.social) reply parent
Indeed. Is he guilty of rape?
Tony Udall (@wivus.bsky.social) reply parent
Well it's bound to happen then
Tony Udall (@wivus.bsky.social) reply parent
It is but morally is subjective. The club would be in a difficult place deciding morals. They probably decided that the law was against them taking any action and morally there wasn't a solid basis to do so
Tony Udall (@wivus.bsky.social) reply parent
Probably legally.
