My take on the Kirk thing is that while political violence is bad, one-sided political violence is even worse. There are Senate Republicans who voted to acquit Trump because of fears for their personal safety. One-sided political violence is one-way ticket to fascism.

The implication you should take is that pandemic restrictions were essentially never enforced against protests but sometimes against churches, based on a observation of the protests that occurred, individual denials (like in DC), and written rules (like in California).

The issue is that the outdoor guidance was definitely and obviously not being enforced for protests at any point in time even if they were being treated similarly on paper.
Over a third of Latino people themselves voted for Trump, because they thought they would be the "good ones" while he would only persecute the "bad ones." They're THOSE people, too.
The reason people wring their hands about it even today is because 1. if you're right-wing: that it was a horrible abuse and you'll be mad forever, and 2. if you're a Very Smart Centrist: that it did damage to trust in public health and science that we're still living with.

But it specifically wasn't all First Amendment activity. You could have protests but not outdoor religious service. There was very specifically one type of activity being promoted.
The people who are in the streets and direct activists don't need to be further activated. A national television fight is aimed at the people who, after nine years of Trump being a fascist, still haven't got the message and never will.
It would have been one thing to say that "outdoors is safe now guys", but singling out one type of outdoor activity specifically because "white supremacy is a lethal public health issue" makes it very clear what the actual message is.
