IMHO Tartan Noir writers are the least likely to include Scots. They're working in a commercial genre for English speakers where the aim is to sell units &, given it's a global market, the setting is essentially irrelevant. It's about telling a good tale (in English) so that it can sell anywhere.

100% agree with the "English literature"/"literature in English" distinction. What intrigues me with your examples is, do they include non-English languages? E.g. does the study of American literature include Spanish and native languages? Quite tricky for one person to teach, I'd imagine 🙂

Re Hamlet, I think the equivalent analogy would be an English writer writing a play in Danish set in Denmark and then wondering why it's considered Danish literature. You're right about RLS of course. True of all writers. Only they can produce their work, no one else 🙂

And apologies if I've forgotten something obvious because I haven't read it for AGES but, based on the text alone, what's Scottish about The Strange Case of Dr Jeckyl and Mr Hyde? It's in English and it's set in London. And Wikipedia tells me it was written in Bournemouth.

Re Burns, the title of "Poems, Chiefly In the Scottish Dialect" is - in English - "chiefly" suggests another language is present i.e. English - "dialect" begs the question "Of which language?" i.e. English If Scottish writers use someone else's language we shouldn't grumble if they "claim" us
