President Donald Trump fired a commissioner of a so-called independent agency without cause. The district court held that such removal was unlawful, ordered reinstatement of the officer, and entered a sweeping permanent injunction that, among other things, ordered everyone at the agency to treat the officer as if she were never removed by the President. In two virtually identical cases, the Supreme Court has stayed similar injunctions. While it is true the removed officer here is a commissioner of the Federal Trade Commission, and the Supreme Court upheld the removal restriction for such commissioners in Humphrey’s Executor v. United States, 295 U.S. 602 (1935), a stay is nonetheless appropriate. The Commission unquestionably exercises significant executive power, and the other equities favor the government. These grounds were sufficient to support the Supreme Court’s judgment that a stay was warranted in two recent cases in which the district court ordered reinstatement of an officer removed by the President. The Court determined that “the Government faces greater risk of harm from an order allowing a removed officer to continue exercising the executive power than a wrongfully removed officer faces from being unable to perform her statutory duty.” Trump v. Wilcox, 145 S. Ct. 1415, 1415 (2025); see also Trump v. Boyle, 145 S. Ct. 2653, 2654 (2025). Because we are required to exercise our equitable discretion in accordance with the Court’s directives, the district court’s order must be stayed. I respectfully dissent.

BREAKING: On a 2-1 vote, D.C. Circuit denies the Trump administration's request to let Trump fire a Federal Trade commissioner during appeals. Citing Humphrey's Executor, about the FTC: "To grant a stay would be to defy the Supreme Court's decisions that bind our judgments. That we will not do."

United States Court of Appeals FOR THE DISTRICT OF COLUMBIA CIRCUIT No. 25-5261 September Term, 2025 President Trump fired Federal Trade Commissioner Rebecca Slaughter without cause. The district court ordered her reinstatement. The government now seeks a stay of that decision pending appeal. That motion must be denied. The government has no likelihood of success on appeal given controlling and directly on point Supreme Court precedent. Specifically, ninety years ago, a unanimous Supreme Court upheld the constitutionality of the Federal Trade Commission Act's for-cause removal protection for Federal Trade Commissioners. See Humphrey's Executor v. United States, 295 U.S. 602 (1935). Over the ensuing decades-and fully informed of the substantial executive power exercised by the Commission-the Supreme Court has repeatedly and expressly left Humphrey's Executor in place, and so precluded Presidents from removing Commissioners at will. Then just four months ago, the Supreme Court stated that adherence to extant precedent like Humphrey's Executor controls in resolving stay motions. To grant a stay would be to defy the Supreme Court's decisions that bind our judgments. That we will not do.

So this statute would be what Trump would likely use to federalize a guard that was under state control (as he did in CA). Once federalized, they are basically federal troops—not state troops under command of Governor. So if 12406, state sovereignty issue not at play.

The language about issuing order through governors is just a procedural/ministerial requirement the president has to follow in order to federalize the guard. 9th Cir. interpreted it to be a pretty minimal — doesn’t give governors veto power over federalization

The LWV, deploring the move, says it's been offering voter registration at naturalization ceremonies "for decades." If he’s using 12406, the statue says he can call into federal service members of the National Guard “in any state.” So I think their argument would be that you can use 12406 to federalize the guard in any state and send them to another w/o raising state sovereignty issues (bc they’re federalized)

Yeah they just become the equivalent of federal troops when in Title 10. But the only way to put someone into title 10, consent of home state gov or not, is via that statute that requires some showing that the federal officials have been impeded from executing the law

And if you live in a blue state, you need to build in more time because of waiting periods, licensing reqs, limited retail/training options, etc. It takes a good deal of time to understand applicable laws and figure out what firearms/ammunition/storage makes sense for you given available options.

If it’s under Title 32 authority, the Texas guard remains under state control. That would mean that one state is deploying armed forces into the territory of a non-consenting state. And that’d clearly be a violation of the principle that states are co-equal, territorially limited sovereigns.

Oh, yes, Texas has a paper trail a mile long arguing that states have the right to fully deploy its state agents to defend its borders and to use lethal force against any invasion. That would inherently include Illinois using lethal force to repel an invasion by the Texas National Guard.

Seems Trump might be trying an end-run in which Texas mobilizes its National Guard. That would be Texas invading Illinois, which as you can imagine is unconstitutional. One wonders about potential remedies, such as IL seizing assets of TX corporations like X, xAI, and SpaceX. Just a thought. 🤔

this is almost certainly under Title 32 authorities (meaning the TX guard will be nominally under TX state control but on a federal mission), meaning the posse comitatus issues that came up in California will not apply. that said, it raises a whole lot of other legal problems

Whereas in California the state’s own national guard was federalized under a law which allows that. The problem there was that they went beyond the very limited things they can do without violating other laws.

I do like that policy. There’s at least one Scandinavian country that got really good results by tying maternity leave to paternity leave. But it’s not a silver bullet. Being an early career professional with young children will always suck and disadvantage all but the very best performers.
