I think this is a good outline. A complexity visible here is that the Democrats need to figure out how to constructively engage with the tech industry. They knew how do to this in the 1990's. That doesn't excuse tech's embrace of Trump, but it is a reality and part of a constructive path forward.

New York’s social media age verification law is a perfect example of bad tech criticism making bad law. Algorithms are used by some sites to drive engagement. They are also useful and necessary. Regulators need to learn how to approach tech issues with scalpels rather than broad swords.

I think SCOTUS has determined that these discretionary rulings (such as in Netchoice vs Fitch) allow for governance to swing severely to the right in the short term, with option of "correcting" in the future if someone else is in the Whitehouse when these cases finally come back for a decision.
