I think this is a good outline. A complexity visible here is that the Democrats need to figure out how to constructively engage with the tech industry. They knew how do to this in the 1990's. That doesn't excuse tech's embrace of Trump, but it is a reality and part of a constructive path forward.

This is good, although I think it fails to fully dissect the causes of Biden admin's allergy to tech policy and the solutions to that. Paraphrasing: "Apple cofounders had barely grown out of their shaggy-haired days selling 'blue boxes,' now the big tech companies have became The Phone Company."

New York’s social media age verification law is a perfect example of bad tech criticism making bad law. Algorithms are used by some sites to drive engagement. They are also useful and necessary. Regulators need to learn how to approach tech issues with scalpels rather than broad swords.

Deleted the below posts out of an abundance of caution. Despite the words of the Proclamation, an unnamed White House official told New York Times that they intend to apply the $100,000 only to new applicants only. If that is correct, the implications are not as urgent.

Assuming CDC formally adopts ACIP's recommendations, CVS tells me it will provide Covid vaccines without a prescription in all 50 states and won't require even self-attestation of a qualifying condition — "it’s up to the individual patient." No confirmation from Walgreens or Walmart yet.

Unless I'm reading this badly wrong and the administration puts out contrary implementation, it would appear that starting tonight, anyone with an H-1B who doesn't write a $100,000 check to the US government is banned from reentering the country if they're currently outside the US.

I think SCOTUS has determined that these discretionary rulings (such as in Netchoice vs Fitch) allow for governance to swing severely to the right in the short term, with option of "correcting" in the future if someone else is in the Whitehouse when these cases finally come back for a decision.

Online age verification is not like "showing ID to buy alcohol" because a) the liquor store doesn't get to scan your ID and store a digital copy of it forever in a database that will inevitably get hacked b) you don't have to show ID to go to the library because they have cocktail recipe books

/7 It’s easy to say why. Saying “you can prosecute flag burning as incitement because it makes people really mad” allows you to say “you can’t criticize Israel/denounce Trump/preach Islam/say reality TV suck because it makes people so mad.” It limits speech to what thug trash will tolerate.
