Definitely a lost battle under this admin, but if we do eventually return to normalcy, would really appreciate a hard requirement that every announced use of force by the state be accompanied by stating the authority under which it occured

Lethal force against a civilian vessel in international waters is a war crime if not in self-defense. If not in self-defense, only non-lethal actions, such as warning shots or disabling fire, are allowed. "Not yielding to pursuers" or "suspected of carrying drugs" doesn't carry a death sentence.

Reminded me of an old edition of D&D which has a starting scenario of you imprisoned with a cheating thief that was meant to teach some probability. Like the thief gives you a d12, but rolls 2d6. Or gives you a d20 but rolls 2d10. Wish I could remember what box set that was.

One is curious how that fits into claims of self-defense. I predict those wedded to the unwilling/unable frame will try to assimilate this.

Again, the key divide within the Democratic party does not map onto a left/right axis: It is between those who want to fight back forcefully, like Pritzker, and those who can’t/won’t shake the impulse to accommodate, appease, and uphold “normalcy.”

If it’s under Title 32 authority, the Texas guard remains under state control. That would mean that one state is deploying armed forces into the territory of a non-consenting state. And that’d clearly be a violation of the principle that states are co-equal, territorially limited sovereigns.

One wonders about the truth of the information as well as all sorts of other things about targeting. Another problem with American autarky is preposterous self-defense claims. Maybe something we're numb to is the very offensive self-defense claims that undergird this sort of action.

We're not at the stormtrooper with DoD ribbons yet (but see developments in immigration and expulsions at DHS) and that doesn't happen instaneously (despite Miller's dreams), but there is a real fear that the DoD will "sleepwalk" its way into just following orders, incident by incident.

It's also groundwork for a narrative that leans heavily into using the military as so much spackle for what ails an already decimated govt capacity and on a so-called sacrosanct budget (the DoD's (and how long that budget will be so given these uses of the military remains unaddressed).

The DC National Guard "deployment" is probably an object lesson for a lot. It's a step along the spectrum to using the military for whatever whim the president dreams as well as a waypoint for civic minded to make an exist and remove expertise & manpower.

This fight against Fed independence reminded me of a passage from S. Hays' "Conservation and the Gospel of Efficiency" (1959). "The crux of the gospel of efficiency lay in the rational and scientific method of making basic technological decisions through a single, central authority." 1/3

I think a further thread is food for thought. There's also, as someone like @sodrock.bsky.social has written, a lot of questions and steps from "everything's hunky dorry" to & toward "Execute Order 66," each of which seems like their own red lines irrevocavly crossed. And so we don't know & argue.

Very interesting and very cool. Spatial references and use of space was always interesting.

Really interesting tidbit of history (the more things change, the more they stay the same) about cops concealing their identity. Maybe an interesting window in the strength of the courts & how they vindicate rights in that period.

Hug a librarian today. My assigned liaison at @northwesternlaw.bsky.social ’s library just used truly sinister and amazing powers to turn up the exact part of the order I needed from a 1965 injunction that the national archives had miraculously digitized.

Where'd you read the Complaint? Is it available, as CNBC apparently van't be asked to link to it.

True, but if they're making their payments, the mortgage servicers aren't going to care. That's (part of) why the mortgage fraud seems utterly pretextual.

What even more wild about the original Ernst scandal is it was propublica that broke the story; think about how many hill reporters sat on it to preserve access
