Lethal force against a civilian vessel in international waters is a war crime if not in self-defense. If not in self-defense, only non-lethal actions, such as warning shots or disabling fire, are allowed. "Not yielding to pursuers" or "suspected of carrying drugs" doesn't carry a death sentence.
Don Dechert (@dondechert.bsky.social)
Reminded me of an old edition of D&D which has a starting scenario of you imprisoned with a cheating thief that was meant to teach some probability. Like the thief gives you a d12, but rolls 2d6. Or gives you a d20 but rolls 2d10. Wish I could remember what box set that was.
Don Dechert (@dondechert.bsky.social)
One is curious how that fits into claims of self-defense. I predict those wedded to the unwilling/unable frame will try to assimilate this.

Again, the key divide within the Democratic party does not map onto a left/right axis: It is between those who want to fight back forcefully, like Pritzker, and those who can’t/won’t shake the impulse to accommodate, appease, and uphold “normalcy.”

If it’s under Title 32 authority, the Texas guard remains under state control. That would mean that one state is deploying armed forces into the territory of a non-consenting state. And that’d clearly be a violation of the principle that states are co-equal, territorially limited sovereigns.

One of which being the minor detail that deploying them off federal property in the territory of one state under another state's authority without the permission of the government of the first state is quite literally an invasion

One wonders about the truth of the information as well as all sorts of other things about targeting. Another problem with American autarky is preposterous self-defense claims. Maybe something we're numb to is the very offensive self-defense claims that undergird this sort of action.

We're not at the stormtrooper with DoD ribbons yet (but see developments in immigration and expulsions at DHS) and that doesn't happen instaneously (despite Miller's dreams), but there is a real fear that the DoD will "sleepwalk" its way into just following orders, incident by incident.

It's also groundwork for a narrative that leans heavily into using the military as so much spackle for what ails an already decimated govt capacity and on a so-called sacrosanct budget (the DoD's (and how long that budget will be so given these uses of the military remains unaddressed).
