Spot on - the Justices are being overtly political, and @imillhiser.bsky.social has receipts. My only quibble is we stop repeating the "Calvinball" label. It's cute, but probably misses the mark for most people. Be direct: "The Republican justices are politicians supporting Republicans." Period.
I don't know who's writing Mr. Mamdani's ads, but they're doing a bang-up job. I've never seen a campaign with such variety, energy, and creativity in the messaging.

Fun Jonathan Mitchell fact: he once filed a suit claiming the Harvard Law Review discriminates against white men, and argued that Twombly/Iqbal didn't apply to his case and conclusory pleading is fine. The judge was appalled enough to describe this "astonishing proposition" in the dismissal order.

I think we are seeing quite clearly that many people (most?) don’t believe in what most of us have thought “law” means. They just care about results, “law” be damned.

The coverage this morning suggests that, no, people are not realizing how insane this is. Or how dangerous. It’s not just wildly illegal (though it is). It also crosses several lines that even (heretofore very adventurous) prior US counter-narcotics ops didn’t cross. And it can get worse
Like, I totally get that it's coming and we're not stopping it. And that my students need to learn it if they want to be lawyers in the future. I'm convinced of that. I just don't want to learn this new tool and then teach it to them. Nor am I really the best person to do that.
What if I don't want to be someone who teaches students how to use AI? Do I have to get a different job? Googling "jobs in bike shops in Vermont" now....

That's the challenge in teaching a class now. I get that. But also, not everyone feels that way.
Taught the first constitutional law class of the semester this morning. It felt very wrong not screaming THIS IS ALL NOT OK every two minutes.
That or play shortstop and pitch for a baseball team. But I'm too old and, more importantly, too untalented for the latter.
No one should feel bad for law professors. It is nonetheless true that anyone teaching constitutional law who isn't dead between the ears or a right-wing ideologue is spending the last few days of summer trying to figure out how to tell the truth without wanting to quit

Working on my constitutional law syllabus for the fall. After a week of introductory material, I usually then have 11 classes about Congress and its powers. That feels incredibly quaint and irrelevant right now!
Agree. They are totally on board, including John Roberts. I don't know why folks keep trying to come up with rationales that avoid this reality.
Imagine if Justice Gorsuch were as concerned with the President not following the Supreme Court and other courts' rulings as he is with three lower courts trying to distinguish Supreme Court precedent in a way he doesn't like.

I wonder though if the blip of time where it wasn't this bad is the exception rather than the rule. Because before Reynolds v. Sims and the VRA, it was much worse than it is now, almost by definition.

My only quibble with this article is that rule of law has long been dead, though in different ways (think policing of communities of color for one stark example).
This is right. Everyone saying "X is a threat to the rule of law" is just wrong. Rule of law is dead. I should just give my students this article on the first day of constitutional law and end the course there.
