I have never seen an emptier statement than the highlighted sentence from Justice Barrett's majority opinion today. Whatever abstract "duty" the President has to follow the law, it's absolutely meaningless if he does not share that sense of duty and the courts cannot compel him to comply with it.
If the Supreme Court thinks universal injunctions are unconstitutional, to wait until *now* to say that, in this of all cases, with this of all presidents, is a devastating indictment of both its impartiality and its prudence.
And of all presidents, THIS president. The first president who has never read the Constitution, who doesn’t know what Article I is about, who attacked Congress to seize power after losing office! He’s the one for whom we’re going to strip away checks and appeal to “duty” alone.
It’s madness - the president’s commitment to the constitutional order is presumed, because he is the president. The idea that the president could explicitly seek to defy and overturn the Constitution, and that he might need functional checks, is treated as an absurdity.
The Dictatorship Decisions: the immunity case last summer, the court’s recent decision refusing to punish Trump for his endless bad-faith defiance of courts on deportations, and now this nightmare decision explicitly carving a pathway to large-scale executive lawbreaking.
The Supreme Court is setting up a de facto presidential dictatorship, in which the president is immune to the law, can openly defy courts with no consequences, and courts are not even empowered to order him to stop disobeying the Constitution.
So why does SCOTUS feel compelled to make any decisions if Dear Leader’s judgment is sufficient?
