I like spending cuts, but impoundment is a very dangerous presidential power that undermines democracy and would bring chaos - which is why it is surely unconstitutional and also banned by the 1974 Budget and Impoundment Act.
This could include unilaterally eliminating enacted spending for a state or a Congressional district. Or the next Democratic president refusing to implement defense or border programs that had already been passed and signed into law.
It turns out that - no surprise - the White House had been illegally hiding a key federal spending database in order to obscure that it was beginning to illegally impound spending, as it had prevously signaled it would do. 🧵 www.washingtonpost.com/business/202...

Finally, impoundment may not fix deficits. Presidents like to reward their voters, not cut them. DOGE just targeted low-cost cultural totems that MAGA hates. Moreover, a president could acquire corresponding power to unilaterally *add* spending in this post-constitutional world.

The LGML case came very close to being JGG redux. But just before the hearing began, the judge decided not to wait. She entered a TRO barring removal of all the children. That made all the difference: DHS already had the kids loaded on planes. One plane even took off (then turned around).
Can we stop to talk about how remarkable the timing was? Compliant at 1am, Judge engaged at 2am, ex parte call to the Government at 2:30am (they did not answer), TRO at 4am? On a Sunday of a holiday weekend?!
