The Supreme Court has original jurisdiction for disputes between states (meaning they can actually file the lawsuit there, rather than have it go up on appeal). This would be a good time for Illinois to utilize it.
Whereas in California the stateās own national guard was federalized under a law which allows that. The problem there was that they went beyond the very limited things they can do without violating other laws.
These problems are even bigger. As a constitutional matter, the deployment of unfederalized Guard personnel into a nonconsenting state can never happen. Never.
