Today we saw LOTS of good critters, including this stunner of a powdered dagger moth caterpillar. Apparently the caterpillars in this species can be all different colors and to some extent hair configurations, looking at the iNaturalist pictures. Very cool to see!

It appears that hundreds were being prepared to be sent back to Guatemala, but only 76 had been loaded onto the plane or planes by the time the judge issued her order to stop

(I deleted an earlier version of this post because I've concluded that the discrepancy between the numbers 76 and 600 isn't a cause for concern. The latter is an estimate of the number of children in the entire putative class—those the govt intends to remove—but they weren't all on planes yet.)

True, though (1) the judge recessed the hearing twice so Ensign could communicate her orders to the relevant people and ask them about the deplaning process, and (2) Ensign said in the hearing that he'd missed the judge's latest order because he hadn't yet made an appearance, so urgency was clear

Judge: I have done all I can to make a decision based on what's in front of me. I will continue to be here and act expeditiously. I am trying to do the best *I* can to fulfill *my* obligations as an Article III judge.
Judge: I got a call at 2:36 a.m. because the govt chose this time on a holiday weekend to execute this plan. I have been up since then. I haven't been able to reach anyone from govt until this morning at 9:30 a.m. So absent this intervention, all children would already have been sent to Guatemala!
Judge: My understanding is we have two paths. One is removal, the other is voluntary departure. Protections are recognition of the fact that this population is incredibly vulnerable. And I don't see anything in what you're saying to me that overrides those protections.
Judge: During recess, I read provision you cited and then the complaint. Every one of 10 named plaintiffs says they are *afraid* of being sent back to Guatemala. (Reads aloud from declarations.) Doesn't line up with what govt is saying. This is why we have courts.

Plaintiffs: No. Possible some children might be in that situation, but everything we could find on short notice is children not in this situation. Judge: Mr. Ensign you saying that *all* these children have parents who are requesting their return to Guatemala? DOJ: That's what I've been told
Judge Sooknanan: Mr. Ensign, tell me your position on what the govt is here, given the legal protections? DOJ: These are not "removals" under the statutes. These are "repatriations" under 6 USC 279 (b)(1)(H). The US is facilitating requests from Guatemalan parents to return their children.
Plaintiffs: Our understanding is that the planes are on the ground in Texas, but the children are still on the planes. Judge Sooknanan: Mr. Ensign, do you understand why? DOJ: I do not, maybe contingent on this hearing
