ALL TARIFFS ARE STILL IN EFFECT! Today a Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed, but they know the United States of America will win in the end. If these Tariffs ever went away, it would be a total disaster for the Country. It would make us financially weak, and we have to be strong. The U.S.A. will no longer tolerate enormous Trade Deficits and unfair Tariffs and Non Tariff Trade Barriers imposed by other Countries, friend or foe, that undermine our Manufacturers, Farmers, and everyone else. If allowed to stand, this Decision would literally destroy the United States of America. At the start of this Labor Day weekend, we should all remember that TARIFFS are the best tool to help our Workers, and support Companies that produce great MADE IN AMERICA products. For many years, Tariffs were allowed to be used against us by our uncaring and unwise Politicians. My write-up from this morning on the Trump administration's attempt to remove Governor Cook from the Federal Reserve Board of Governors (and the lack of market reaction).

Cook. Last night President Trump posted a letter claiming authority to remove Governor Cook from the Federal Reserve Board of Governors (BoG) for “cause”. Recall that back in May, the Supreme Court gave the President broad powers to remove the heads of independent agencies but tried to ring-fence the Federal Reserve. We discussed that ruling in The Morning Lineup dated May 23 (link). Given the clear signal from the Supreme Court that they would not accept a discretionary removal of BoG appointees, President Trump has not attempted to remove Chair Powell (despite hostile rhetoric directed at the Chair). But that has not been the case with Fed Governor Cook as the President attempts to exert more control on the Federal Open Markets Committee. Using the allegations from FHFA Director Bill Pulte, who made allegations of mortgage fraud against her (discussed in The Closer dated August 20 (link)), last night was the culmination of that effort. It’s not clear how exactly this situation plays out near term. For example, it’s possible that the Board of Governors at large announces it does not recognize the removal notice. Alternatively, they may announce they are complying with the notice and Governor Cook has been removed. In either case, there will be immediate litigation in Federal court seeking to establish whether the President has the right to remove her or not. Either way, Governor Cook’s statement last night made it clear that she intends to fight the removal: Cook (con’t). Leaving legal niceties aside, this litigation will end up in the Supreme Court at some point. The fact that the court made a concerted effort to ringfence the Federal Reserve in its Trump v Wilcox decision back in May would suggest a positive outcome for Cook provided the “cause” the president cited is not viewed as valid, but we would not take that outcome as a given. The Supreme Court majority has ruled in favor of the President’s side so far this year. Between May 1 and June 23 of this year, Trump administration cases in federal district courts have only seen rulings in the administration’s favor 6% of the time (82/87). Circuit courts (courts of appeal) have sided with the President more frequently but still only 32% of the time (7/22). But over that period the Supreme Court handed down 93% favorable rulings (15/16). In another example, the Trump Administration made 19 applications for emergency stays from the Supreme Court over its first 20 weeks through mid-June; at that point it had received favorable rulings on 10 of the 12 applications that had been adjudicated. Empirically, SCOTUS has ruled overwhelmingly in favor of the President so far this year, while other courts have ruled against his administration’s moves. That deference is relevant for the market reaction to this event. The Bloomberg US Dollar index initially fell 32 bps, before reversing all of those losses later in the session. The 2s30s UST curve hit new cycle wides (steeper, indicating higher inflation risk premium) in response but the move was about 6 bps, which is relatively modest in context. FX and rates are the “cleanest” read on the market impact of threats to Fed independence: as we noted in The Closer last Thursday (link) days with higher salience for Trump’s attacks on the Fed have led to dollar and bond underperformance this year, even though equities have still averaged gains on those days. That’s a rational approach from markets. If the Federal Reserve were to start run… Cook (con’t). So why the relatively small reaction from the market? Investors have been repeatedly trained this year to ignore the noise of the Trump Administration and have been rewarded as a result. In equities, the “Liberation Day” tariff announcement that generated a flush to April lows for stocks was very much temporary given the rally since despite worse tariff outcomes than were assumed at that point. The dollar has also started to bottom out after its first half collapse, and while rewards of ignoring Trump catalysts for dollar bulls have so far been modest, the Bloomberg USD Index’s massive drop of almost 5% in 9 sessions from April has not been repeated. Finally, for rates, the TIPS market showed signs of stress in April, but real yields have since fallen back to where they were in March while long-end steepening has been similar to other global moves. With that history, why would markets get pessimistic? Allowing a situation to develop where any President can replace any Federal Reserve Governor based on allegation alone is a threat to the stability of monetary policy. The market’s assumption is clearly that central bank independence will win the day.

The Federal Reserve Board of Governors has been around for 111 years. In that time it has had more than 100 members (en.wikipedia.org/wiki/Federal...). No president has ever fired (or claimed to have fired) one before.

Earlier this year, SCOTUS tried to construct a stupid legal framework where the President was allowed to destroy basically all independent institutions except for the Federal Reserve, which was deemed too economically important. Unsurprisingly, even that was not enough for Trump.
