Lowell sarcastically asks whether responding to Bill Pulte right away on social media is the process that the due process clause allows.
Adam Klasfeld (@klasfeldreports.com) reply parent
In rebuttal, Lowell says: "Just putting the word 'cause' next to Article II doesn't make it better." "So if that's not enough, the President gave you what he meant." Trump said if Cook acted "properly," referring to the interest rates.
Adam Klasfeld (@klasfeldreports.com) reply parent
Judge Cobb notes that the standard is deferential but that doesn't mean not to probe it. She asks what that standard is for that review.

DOJ's lawyer notes that Cook did not reveal her defense to the mortgage fraud allegations. “They are very careful in this brief not to make any representation about what actually happened.”
Adam Klasfeld (@klasfeldreports.com) reply parent
DOJ says that Trump did not say in his letter that Cook was removed out of his Article II discretion, period.
Adam Klasfeld (@klasfeldreports.com) reply parent
The government is now up: Judge Cobb presses the DOJ on whether a policy dispute is enough for "cause," and the lawyer agrees, except potentially in extreme situations, that it is not.
Adam Klasfeld (@klasfeldreports.com) reply parent
Lowell: "Whatever 'cause' means, it can’t be this. Whatever 'notice and opportunity' means, it can’t be this."
Adam Klasfeld (@klasfeldreports.com) reply parent
Lowell notes that a Fed governor takes an oath to protect and defend the Constitution — and another one to operate independently. Being removed from such a position, he says, is irreparable harm.
Adam Klasfeld (@klasfeldreports.com) reply parent
Lowell notes that the right to respond wouldn't be to Trump: "I didn't imagine that I'd walk into the Oval Office and give a 20-minute presentation that Director Pulte is wrong."

Lowell notes how Trump turned his attention from Jerome Powell to Lisa Cook: "Miraculously, the President's ire turned from Chairman Powell to Gov. Cook." ... "This allegation of fraud has become the weapon of choice in removing people from the Board."
Adam Klasfeld (@klasfeldreports.com) reply parent
Lowell: "If it is abundantly clear that there was no cause — I don't know what it is, but I know what it's not — ... then, yeah, you don't need to get to motive."
Adam Klasfeld (@klasfeldreports.com) reply parent
Lowell on the judge's role in determining whether "cause" is pretextual: "Whatever we define as permissible cause is not depending on the bad motive of the actor." ... "A bad motive can illuminate that there was no cause to begin with."
Adam Klasfeld (@klasfeldreports.com) reply parent
Lowell on the applicable standard: "It's very difficult to come up with an 11-page definition of what it is." But it's easier to come up with a one-page definition of "what it's not." "Whatever it is, it's not this."
Adam Klasfeld (@klasfeldreports.com) reply parent
Judge Cobb asks where Lowell finds the authority that suggests this is the standard. Lowell acknowledges that this is a "case of first impression."
Adam Klasfeld (@klasfeldreports.com) reply parent
Lowell: "What is the alleged offense that occurred before? What's the evidence of the offense that occurred before?" Has the person had the chance to contest the allegations?
Adam Klasfeld (@klasfeldreports.com) reply parent
Lisa Cook filed the mortgage application at issue before her confirmation. Judge Cobb presses Lowell on whether the timeline makes it categorically ineligible as "cause." Lowell says it's not an "absolute condition" but a factor.
Adam Klasfeld (@klasfeldreports.com) reply parent
Judge Cobb notes that other statutes have defined "cause," and this one doesn't. Lowell responds that "cause" is defined in the Supreme Court precedent of Humphrey's Executor.
Adam Klasfeld (@klasfeldreports.com) reply parent
Judge Cobb presses Lowell on the government's legal argument. The Federal Reserve statute doesn't define cause and that allegedly means the president has discretion. If "cause" is undefined, Lowell replies, either the word "means nothing" or the judge must determine it.
Adam Klasfeld (@klasfeldreports.com) reply parent
Lowell notes Pulte's hedging around her allegations against Gov. Cook — that it "appears" that she did something wrong.

A trafficking charge can get someone the 20-year sentence that Maxwell is serving. The average sentence on the charge leveled against Abrego in the district where he’s being prosecuted: roughly a year and a day, per a recent court order.

To correct a point that DHS keeps obfuscating: Unlike Ghislaine Maxwell, Kilmar Abrego Garcia has never been charged with “trafficking” anyone. The trial the Trump admin is trying to avoid with its Uganda scheme is on smuggling accusations. www.allrisenews.com/p/kilmar-abr...
