Having been involved in politics since the days when flag-burning was a more popular protest action, I'm not at all surprised to see him charged with a burning-stuff offense because burning flags is protected speech. This is not a new police tactic.

While Mr. Carey set fire to his own flag, he was very careful not to endanger anyone or anything. That's the actus reus. It was not Mr. Carey's intent to harm anyone or anything. It was his intent to protest an unconstitutional executive order, as was his 1st Amendment right. No mens rea.

This is frankly the worst anyone should be punished. Bear no more severe consequences than by lighting your pillowcase or a hand towel on public or private property. But even then protest may grant some latitude like protected assembly vs loitering. A small price to pay for the right to protest.
