this is almost certainly under Title 32 authorities (meaning the TX guard will be nominally under TX state control but on a federal mission), meaning the posse comitatus issues that came up in California will not apply. that said, it raises a whole lot of other legal problems

If it’s under Title 32 authority, the Texas guard remains under state control. That would mean that one state is deploying armed forces into the territory of a non-consenting state. And that’d clearly be a violation of the principle that states are co-equal, territorially limited sovereigns.

I am serious when I say that none of those actions would be more radical than what Trump is currently using his executive power to do—almost always with permission from the Supreme Court. And if the judiciary stands in the way, why not follow Judge Emil Bove's maxim and "tell courts 'fuck you'"?

Not sure if it's obvious how bananas this is. The usual tariff argument is that it helps producers and hurts consumers (by more). But Trump's tariffs don't even help (most) producers. It's genuinely difficult to design a tariff regime that helps less than 4% of manufacturers!
