I remember it was summer 2020 when I started writing on what was then a fringe & thus overlooked argument that discrimination against “persons seeking gender-affirming care” is not discrimination against trans people b/c not all trans people seek such care. It's surreal to see it now as law, period.
Skrmetti’s reasoning here is directly referencing a 1974 case, Geduldig v. Aiello, holding that pregnancy is not a gender issue because “nonpregnant persons” can be any gender. Legal scholars never took seriously how Geduldig leads to “banning trans care is not trans discrimination.” So here we are.
we knew Skrmetti would be a train wreck all the way from the ACLU’s decision to appeal it but now on top of it we have to sit through a long year of cis academics and the chosen trans commentators occupying the airwaves talking about “this is how you get the trans issue right” nonstop

But I care so much for the trans people still doing philosophy that I can't help but promote their words, share in their hopes, and wish for something better.
When I left the discipline, I was one of two trans femmes of color with a PhD in philosophy and I could not see, or even imagine, a department that would hire me. Leaving ended up being on of my best decisions, an opportunity to leave an abusive relationship on my own terms.
