I remember it was summer 2020 when I started writing on what was then a fringe & thus overlooked argument that discrimination against “persons seeking gender-affirming care” is not discrimination against trans people b/c not all trans people seek such care. It's surreal to see it now as law, period.

Skrmetti’s reasoning here is directly referencing a 1974 case, Geduldig v. Aiello, holding that pregnancy is not a gender issue because “nonpregnant persons” can be any gender. Legal scholars never took seriously how Geduldig leads to “banning trans care is not trans discrimination.” So here we are.
