If you published a recording but didn't register it, you can't walk into court and say "Mr. Judge Sir, here is my copyright registration" and be done, but you can give them a copy of your CD and get someone from the record company to state the date of publication and that's enough.

So, basically, if you lawfully make a recording, your recording is copyrighted - registering it is just registering it, it makes it easier to prove in court that you did it but registration is not legally necessary to be protected by copyright. You may not own the *song*, you own the *recording*.

The really cool thing to do is what the Rolling Stones did. Trump was using their song at rallies, they asked him to stop. He didn't. Then they basically said "Stop or we'll sue your ass and we've got enough coin to buy all your lawyers and properties twice and still have plenty left." He stopped.

A video differs because there's no venue to have a licensing deal. If DHS licensed it from the label the band may be upset but they have no legal recourse but to say "don't do it again!" but if no license was made DHS is in trouble, I think it's $30k per copy, including every single download.

The fact it can be construed as advertisement is probably the angle to take. That's where things escalate. I'm guessing DHS intentionally used it for advertisement, and that's when you get faster action.

Rallies are different from a video because a rally takes place at a venue, and often the venue has a licensing deal with publishers, so they just pay a licensing fee and it's fine, so to paraphrase what the Stones said, it's "that was legal but we're explicitly revoking permission to do it again."
