Getting DNA off any discarded food or drinks is legally valid. It’s not uncommon and likely won’t create any issues of inadmissible evidence obtained as a result of getting the DNA that way. It’s the same way in which Law Enforcement can go through trash you set outside and get DNA from that.

That’s a different argument entirely. But it’s also super unlikely to work as an argument. They had reasonable suspicion to detain him, then gained probable cause to arrest him from…all the illegal stuff he had on him. There’s also a misconception that he had to have rights read before arrest.
It also isn't a very accurate way to test. For a clean sample you want a cotton swab from a cheek. Off food your most likely only have a partial sample that could match thousands of people in the area. But the CSI affect mean juries assume it's always extremely accurate & only shows one person.

You've gotta know the fix is in to crucify this guy. If necessary, they'll find a frame in the surveillance video where he spits on the sidewalk and then pass a federal law retroactively declaring spitting on the sidewalk "terrorism".

I hate to say this, but I have served on a couple of local juries and tried to render an honest verdict, but I would have a difficult time convicting ANYONE of ANYTHING while a Felon is running the Injustice Department.
I've got jury duty next month, and I'm struggling with that. Hopefully I end up on a case of scumbag company vs scumbag lawyers, or something like that.

It has occurred to me that if the government is worried about a possible jury-nullification, they may intentionally botch the case to get a mistrial instead. For them that could be preferable over being humiliated in the court room.

I think the lawyer is saying that there wasn't reason to arrest, so anything that happened while under arrest is from the poisoned tree.

Unfortunately they don't. Courts have consistently ruled that cops don't need a warrant or permission to take food, drinks, or other discarded items/trash and test them for DNA. That's why lawyers always tell you not to accept any food or drinks from the cops and not to talk to them
