Because there’s a Congress-imposed limit of 10k visas available per year. Over 100k applicants in line. Families (principal applicant plus relatives) ought to be approved together and not counted separately but (shrug)

Having helped process loads of U visa applications, the 10k limit per year is obscenely low given rates of victimization of immigrants. Also, in years gone by, filing a U visa locked the alien file away in the VSC, making deportation proceedings essentially impossible. WTF

2 things pop out, the first of course how evil this admin is but how broken the immigration system really is, since it has been 7 years from the granting of the u visa. In that time period the system was unable to finalize permanent residency w/ the job he is doing, and the vetting that is done.

I'd take a bullet before I let ICE drag off one of my carriers. Those are his people and he's responsible for making sure they do their jobs and go home at the end of the day. "Everyone here is legal and this is an active fire zone, you need to leave" is the least he could've done.

What they argue in court aside, I suspect this is what they will say in media.
Given the timing, likely not a U Visa. Possibly a bona fide determination, possibly still awaiting a bona fide determination given currently backlogs.

One of my clients just got a U BFD. They are still granting them.
I was under the impression that was about revoking ICE policy requiring them to expedite BFDs for people in detention, but I’m not entirely clear either.

I gave to ask. How did they contact each other? Manning must have contacted the firefighter right? The average Joe doesn’t know who Manning is and could not afford him if they did.
For various complicated legal reasons, that is unfortunately unlikely. You basically can’t get money damages for a case like this.
Like with all things Trump and this DOJ, it’s not about the ultimate outcome, it’s about the arrest. These poor men are being held in detention centers and being moved around cut off from their loved ones. Even if they are ultimately freed the damage has been done.
What can you get? Just un-detained? Which should have been the actual situation?

Oh, it’s even worse than you think. He definitely doesn’t have the U visa yet, since the waiting time for a U visa application *approved* in 2018 was already around 14 years. It’s been seven years since he *filed* so he *probably* got preliminary approval and deferred action in the last few years.
Knew I probably got the fine details and nomenclature incorrect. Same concept applies 7 years after granting the application is more than enough time to process it in a working system.

Nope, and he’s not being prosecuted, ICE is trying to deport him. And it’s to do with the fact that you generally can’t sue federal law enforcement for civil rights violations like you can sue state law enforcement. There’s no law authorizing federal courts to hear those suits.

Processing times just for a “bona fide determination* were already 3-5 years in 2018. COVID exacerbated delays. He *probably* passed that stage already, but no guarantee. *USCIS reviewing the application and confirming you qualify, despite a multi-decade delay for the visa to become available.

Nope, immigration enforcement is civil law enforcement, not criminal law enforcement (prosecutions). And yes, the inability to sue federal law enforcement to the same extent as state and local law enforcement is a big problem. Look up “Bivens.”
