Plenty of EU countries (quite rightly) did the same with Brits that failed to register residency as required before the deadline. This individual can still appeal and apply for settled status after the deadline if he has a valid reason for missing it. www.independent.co.uk/news/uk/home...
Plenty of EU countries (I speak from family experience) had a habit of registering people properly before UK's exit, this making things simple when it happened. You can stop now, nothing you say will prove the home office to be any more competent.

but such an appeal can be judged against the applicant on the basis the valid reason isn't considered to be valid enough, which is clearly preposterous if they have continued evidence of residency. you'd judge a spouse visa on the latter for residency, to judge this NOT on said evidence is perverse

No, it’s just how immigration systems work the world over. Whether it’s EU citizens in the UK or Brits in the EU those that don’t fulfil the requirements are at risk of being deported. There is a measure of personal responsibility that needs to be taken to ensure one is compliant with the rules.
