I assume class actions still exist. I'm not sure this is as awful as it looks on this one issue, provided the SC doesn't actually think birthright citizenship is unconstitutional, which does not appear to be the case. It's a disaster for the work loads of lower courts, though, that's for sure.

It does, yes. But that's cold comfort to those who have had their citizenship revoked and are unable to get relief as that process takes place. Or are in a district with a MAGA judge. Or are unable to afford legal counsel. Or are not a part of the class based on some arcane technicality.

The only thing this ruling truly does is further entrench SCOTUS' long term goal of establishing itself as a ruling, legislative body. They will weigh in on individual cases at their leisure, as they see fit, and allow ideologically aligned lower stays to stand.

If something happens to stop a nationwide class from being certified within 30 days, many children born in the US will not be citizens. Everyone seems to think this is just a game and it will all be fine because class actions. Can’t count on it. Inductions, C-sections and abortions commence.

The problem with class action lawsuits is that they are very difficult to bring in, crazy expensive of course, and most of all take years and years.

With the publicity of this issue, I'm not sure the first two will apply. It could take a while, it's true, especially in bad districts, but the class of "birthright citizens" is well-defined, large, and undeniable. And all have the precise same, simple remedy. It's the quintessential class action.
