If the music was satiric it might pass, but just using the mark to represent a normal band infringes the copyright. Remember, these laws also protect small companies from having their work stolen by large corporations.

There are lots of companies selling shirts with parodies of company logos though. I'm guessing they just didn't want the hassle of fighting it. I think they could have won.
