BART counts, but every non-"urban transit county" (<15 rail stations) was previously designated Tier 3, so removing 3 = no CCC regardless of frequency

I don't know, but I suspect Grayson was one of those it was meant to flip (he changed from NVR to Y between committees and I think that was one of the changes in that interim)

in fairness to Senator Grayson, at the time "urban transit counties" were defined those areas outside them were still in the bill, just at a reduced intensity
