I haven’t seen anything to suggest that Rep. Collier has actually tested whether it is a “requirement.” We’re told when fighting fascism, not to “comply in advance.” All of the other Dems complied in advance by signing the permission slip. Collier, to her credit, didn’t. But, then she just sat down.

Collier’s habeas petition doesn’t claim she was physically prevented from leaving or that she ever tried to leave. As a matter of Texas law, merely threatening to have someone arrested is not restraint or confinement. By not testing the boundary, Collier acquiesced—she chose to be there.

Get up, and walk out. It will force them either (1) to let you go (weak) or (2) physically detain you (fascist). Either is a win. Without actually testing the boundary, you can’t know if there is one.
