His lawyer admitted that he (KAG) was a deportable alien. That was back in 2019. Need a link?

His deportation, illegal and unlawful as an Immigration Judge order issued in 2019 forbade his deportation to El Salvador. Mr Garcia was granted “withholding of removal” under INA § 241(b)(3)- application was time-barred w/o exception. No criminal or security bars existed to bar his grant of asylum.

You don’t know what “withholding of removal” actually means. Let me quote “Withholding of removal, in contrast to asylum, confers only the right not to be deported to a particular country rather than the right to remain in the U.S. INS v. Aguirre-Aguirre, 526 U.S. 415 (1999).”

Thank you for the info, I will spend some time looking through it. Please note that I never said he had the right to remain. I just quoted the judgement so that others could be aware of actual facts. Always pleased to learn from fellow posters.

The judge took the easy way out. Note that the request for asylum was denied. The judge ruled that he (KAG) could not be deported back to El Salvador. The administration made (and has admitted) a mistake. Now they are going to send him to Uganda (or perhaps Costa Rica).

The one-year time limit made the denial of asylum unequivocal and unambiguous. Had the Federal judge based his denial of MS-13 membership, more debate might have ensued. The court transcripts are online. Need a link?
