She was told by a lawyer how much tax was due. Does not sound like it was her fault in my opinion. Sounds like targeted fishing for rage bait.
It really depends on the legal advice she claims she got. If she mentioned the trust then she's okay, this is an honest mistake on her part. If she didn't then that's on her.
So yes, let's see the advice and if it says she only has to pay the lower amount of stamp duty then she's in the clear. Always assuming she told the advisor the flat was never intended to be her main home...
But itβs very disappointing that she made such a mistake (if that is what it was). We expect better of her.
